The UK offers a range of visas to allow foreign nationals to work in the country - two of which are the Skilled Worker visa and the Scale-Up visa. The Skilled Worker visa is a primary route for foreign nationals seeking employment in the UK, while the Scale-Up visa is a newer route designed to help businesses scale up by recruiting top talent from overseas.

An overview of the Skilled Worker visa and the Scale-Up visa

Skilled Worker visa

The Skilled Worker visa is the primary route for foreign nationals seeking employment in the UK and requires individuals to have received sponsorship from a UK Visas and Immigration (UKVI) licenced employer. The Skilled Worker visa is valid for up to five years, after which individuals may qualify for Indefinite Leave to Remain and ultimately, British Citizenship.

 

Scale-Up visa

The Scale-Up visa is a route which helps businesses to ‘scale-up’ by enabling them to recruit top talent from overseas. The Scale-Up Worker visa allows talented individuals, who have a job offer from an approved 'Scale-Up business', to reside and work in the UK for up to two years. During the initial six months, applicants must be sponsored. However, after this period, they have the freedom to switch jobs or become self-employed without needing to obtain a new sponsor.

 

What is the difference between the Skilled Worker visa and the Scale-Up visa?

Costs

The costs associated with the Scale-Up Worker visa are less than those associated with a Skilled Worker visa.

Skilled Worker visa

    • The cost of obtaining a sponsor licence varies between £536 and £1,476 depending on the size and type of organisation. 

    • Businesses must pay £199 every time they assign a certificate of sponsorship to a sponsored worker under the Skilled Worker route.

    • Businesses are also required to pay the Immigration Skills Charge which is £364 for small businesses and charitable organisations. For medium and large organisations the Immigration Skills Charge is £1,000 for each year of sponsorship of the skilled worker.

    • A Skilled Worker application fee is between £625 and £1,423, with the amount depending on circumstance.

 

Scale-Up visa

    • The cost of obtaining a sponsor licence is £536 regardless of the size and type of organisation. 

    • Businesses must pay £21 every time they assign a certificate of sponsorship to a sponsored worker under the Scale-Up Worker route.

    • Businesses do not have to pay the Immigration Skills Charge.

    • A Scale-Up application fee is £715.

Skill Level

The skill level is higher for a Scale-Up visa holder.

Skilled Worker visa

    • To be eligible for a Skilled Worker visa, applicants are required to have a job offer for a role that is skilled to at least RQF Level 3 (which is equivalent to A-Levels).

 

Scale-Up visa

    • To be eligible for a Scale-Up Worker visa, applicants are required to have a job offer for a role that is skilled to at least RQF Level 6 (which is equivalent to a degree).

 

Minimum Salary 

The minimum salary requirement is higher for the Skilled Worker.

Skilled Worker visa

    • The minimum salary that must be paid under the Skilled Worker Visa is £25,600 per annum or the going rate for the job, whichever is higher. It is important to note that there are circumstances where the going rate salary can be lower for Skilled Workers.

 

Scale-Up visa

    • The minimum salary that must be paid under the Scale-Up visa is £33,000 per annum or the going rate for the job, whichever is higher.

 

Sponsorship

The sponsorship requirements associated with the Skilled Worker visa are more stringent than those associated with the Scale-Up visa.

Skilled Worker visa

    • Skilled workers must remain sponsored by their employer throughout their visa status up until they have been in the UK for five years after which they can apply for settlement, provided they meet the eligibility requirements.

    • A skilled worker will only be able to switch employers if the new employer is able to transfer their skilled worker sponsorship. 

    • A skilled worker is permitted to bring their dependents.

 

Scale-Up visa

    • Scale-up visas are granted for an initial period of two years, with only the first six months requiring sponsorship. Following the initial six months, scale-up workers are free to work without sponsorship and are able to switch employers or become self-employed. 

    • They can also extend their visas without the need for sponsorship as long as they continue to meet the scale-up requirements. 

    • After a period of five years, scale-up workers can apply for indefinite leave to remain, provided they meet the relevant requirements at that time. 

    • Dependents are eligible to join scale-up workers under this route.
