Frequently asked questions

How long does it take to process an asylum claim?

The Home Office tends to usually make a decision within 6-months of submitting an application. However, this time can be shorter or longer depending on the complexity of the case.

What support can I get if I claim asylum?

In the UK, asylum seekers are entitled to accommodation and a cash allowance.

If you ask for accommodation then you won’t be able to choose where you live and as a minimum you will be given £40.85 a week.

Can I work if I am waiting for a decision about my asylum claim?

If you are awaiting a decision on your claim then in most cases you won’t be allowed to work - instead you will be entitled to a cash allowance and accommodation whilst you wait. If you already have a right to work at the time of application then you will be allowed to work in the UK (e.g. you were already in the UK on another visa but have since made an application to claim asylum).

Additionally, if you made a claim for asylum over a year ago and you are still awaiting a decision then you can apply to the Home Office for permission to work in the UK. An application does not have to be granted, rather the Home Office will only grant applications whereby the delay in processing is not the applicant’s fault.

Can I access an interpreter?

Yes, we offer the services of an interpreter for those who require it. If you want an interpreter then please let us know before you attend any appointments.

What happens if you don't take on my case?

Sometimes issues relating to capacity and our apprehension regarding the prospects of an application may result in our immigration lawyers not taking on your case. In these instances, we will advise you on other options and other immigration law firms and services which may be of benefit to you. Matters of immigration can be sensitive and evoke painful emotions which is why we will always do our best to guide you to other services to help and resolve your case.

Do you accept legal aid?

Yes, we do have a contract with the Legal Aid Agency which means that for certain cases we are able to offer free legal advice and assistance. However, not all cases will be eligible for this funding. Therefore, please speak to your immigration lawyer to see if you are eligible for Legal Aid, and if so, we will then assess your case.
